1. Read the application filed for condoning the delay for
filing written statement and for taking the written
statement on record.
2. The Ld. Advocate of applicant has not taken any
specific objection.
3. Record of the proceeding shows that the notice
was served upon the insurer on 19/11/2024. In respect of
delay caused insurer has contended that the delay is not
intentional or deliberate but due to non-communication by
the previous lawyer and due to that delay is occurred in filing
the written Statement. Even though the said contention of
the insurer is considered as it is, it shows lethargic approach
of the insurer. Therefore, considering all the said aspects and
for adjudication on merit, I pass the following order.
ORDER
1. The application is allowed subject to payment of cost of
Rs.1,500/- to Legal Aid.
2. The insurer do comply condition of cost on or before
next date.
