1 Heard Counsel for applicant. Perusal of the pleadings
of the applicants, it shows that, the applicants are resident
of Kondhavale Gevarwadi post Vasole Tq-Wai Dist Satara
The opposite party is resident of Bidar Karnatka State, the
accident took place within jurisdictional of police station
Khalapur Dist Raigarh. The applicants have submitted this
claim application only on a ground that, insurance
company having its head of at Mumbai.
2. Considering the pleadings, Wai Dist Court or Alibag
Dist Court having jurisdiction of all the proceeding of
MACP. The reason for invoking jurisdiction of this Tribunal
not satisfactory. This is fit case for return of
plaint/application, but, this Tribunal received a letter from
Hon’ble Registrar General Bombay High Court No
RG/1611/96/2026 dt. 5th May 2026 directing the Chairman
as under,
“Apropos the subject, I am directed to inform
you to follow the interim order dated 28th
April 2026 passed by the Hon’ble High Court
of Bombay (Coram : N J Jamadar, J.) in Writ
Petition No-5661 of all other identical matters,
pending before the Motor Accident Claims
Tribunal Mumbai”
3. In the said Writ Petition Hon’ble High Court stayed
the effect of order of return of plaint/application. In view of
the above letter, I am satisfied that, this is fit case to stay

the proceeding till the decision of said Writ Petition.
Hence, this application is here by stayed till the decision of
Writ Petition No.5661 of 2026.
