ORDER BELOW EX.17 in MACP No.1205 of 2023
The Director of Insurance submitted this application for
deletion of their name under Order 1 Rule 10 of CPC alleging
that the offending vehicle was not insured with their
department.
2. Ld. counsel for opp. party admitted that the offending
vehicle is not insured with the insurer department. The counsel
for applicant raised an objection.
3. The claim petition is submitted by applicant u/sec.166 of
M.V. Act for compensation of injury in vehicular accident.
4. Considering the reply of opp. Party, I am satisfied that
insurer department is not necessary party therefore, application
deserves to be allowed. Hence, I proceed to pas following order
ORDER
1. Application is hereby allowed.
2. Applicant is hereby directed to delete the name of insurer
