In MACP No.1143 of 2023
1. The applicant sought interim relief u/S. 140 of Motor
Vehicles Act, 1988 for the injuries sustained in the motor
vehicular accident.
2. The insurer failed to file its say on Ex.2.
3. The alleged accident took place on 02/03/2023. The
applicant has filed this petition on 27/06/2023 as per the
provisions of Motor Vehicles Act. Considering the date of
accident and provisions of Motor Vehicles (Amendment) Act,
2019 (32 of 2019), as per the said amendment provision
Chapter 10 containing sections 140 to 144 were omitted w.e.f.
01/04/2022. Therefore, in view of the said amendment the
present application filed as per Section 140 of Motor Vehicle
Act, 1988 is not maintainable. Hence, I pass following order.
ORDER
1. Application Ex.2 moved as per Section 140 of M. V. Act
is hereby dismissed.
2. Parties to bear their on costs.
