IN CLAIM APPLICATION NO.637 OF 2015
1] This is an application filed by the applicant No.2 for recalling the
amount in the name of original applicant No.1 and to pay it to the
applicant No.2, as the applicant No.1 is no more. The Application
No.637/2015 was filed and decided by judgment and award on
19.01.2022.
2] The Death Certificate filed by the applicant issued by Gram
Panchayat Meru, Government of Jharkhand shows that the applicant
No.1- Ahmad Hussain died on 07.01.2022. It is prayed that the entire
amount be paid to applicant No.2 i.e. mother of the deceased since
applicant No.1 is no more.
3] I called the report of the Accounts Officer. It is seen that the
amount of Rs.10,44,356/- is in the name of applicant No.1. After
perusing the documents on record and affidavit filed by the applicant, I
am of the opinion that as the applicant No.2 is the wife of the original
applicant No.1, thus, the amount in the name of applicant No.1 be
recalled and should be paid to the applicant No.2 on due verification
and identification. Hence, the following order:-
ORDER
1. Misc. Application No.376/2022 is allowed.
2. The share in the compensation amount due in favour of the
applicant No.1- Ahmad Hussain be recalled and be paid to the applicant
No.2- Mrs. Kolsum Begam on due verification and identification.
3. Misc. Application No.376/2022 is disposed off.
