notice on 5.7.2023 on opposite party no.2. Therefore, the
ex-parte order has been passed on 3.10.2023.
3. The matter is posted for the evidence and applicant’s
witness no.1 filed his affidavit. The applicant gave his no
objection to allow the application. Considering the nature
of the matter and to hear the matter on it’s own merit, it
would be proper to give an opportunity to the opposite
party no.2 to put his defence, but as the opposite party no.2
has not appeared in spite of the service in the year 2023,
the following order is passed,
ORDER
1. The application is allowed subject to the cost of
Rs.3,000/- which is to be paid to the applicant.
