Order Details: Copy of Decree Pdf Text: .. 1 of 2 .. MACP NO.1058/2022 ORDER BELOW EX.2 IN MACP NO.1058 OF 2022 Perused the application, say and documentary evidence. 2. This is an application seeking compensation under Section 140 of the Motor Vehicles Act (for short “the Act”). 3. It reveals that in an accident occurred on 07.01.2022 at about 09.30 hrs., the deceased had sustained severe injuries and died thereof. In that accident, the Motor Taxi bearing No.MH-02-BQ-9160 being driven by driver of respondent 1 and insured with respondent No.2 was involved. He is survived by the petitioner 1 and 2- widow and major son. The matter was reported to Sion Police Station vide Crime No.5/2022 came to be registered against the driver of offending vehicle under Sections 279, 337 and 304-A of IPC. 4. Since who was at fault could not be looked into while dealing with proceeding under Section 140 of the Act, hence, the order. O R D E R 1 Application Exh.2 stands allowed as under :- 2 Respondents 1 & 2 shall, jointly and severally, deposit an amount of Rs.50,000/- (Rupees Fifty Thousand only) in the Court, as compensation towards N.F.L. within 1½ months. Failing which, the amount shall carry interest at the rate of 7% per annum in below stated bank account of this Tribunal directly by NEFT/RTGS:- -- 1 of 2 -- .. 2 of 2 ..
