1. This is an application by HDFC Ergo General Insurance Co.
Ltd. for allowing them to file their written statement by setting
aside Order of no written statement dt. 19.07.2023. This
application is supported by an affidavit of Legal Officer of the
said company.
2. This application is strongly opposed by the Ld. Adv. for the
claimant.
3. Heard Ld. Advocates for both parties.
4. Basically, if written statement of the HDFC Ergo General
Insurance Co. Ltd. is not accepted, there will be no decision on
merits and that will keep the Insurance company unheard. In
that event, there is every possibility that the matter would reach
up to the Hon’ble High Court and another round of litigation
would began by consuming another decade. On the contrary, if
the written statement is accepted, the claim petition will be
decided on merits without keeping anyone unheard. Hence,
following order is passed:-
ORDER
1. Application Exh.16 is allowed.
2. Order dt. 19.07.2023 of no say of the HDFC Ergo General
Insurance Co. Ltd. is set aside and their written statement is
accepted, read and record.
