1. Read the application moved for amendment in
written statement by the insurer and say filed thereon by
the applicant.
2. According to the insurer, after filing written
statement Charge-Sheet is filed on record and thereby, it is
revealed that driver of the offending vehicle was also
Charge-sheeted for offence punishable u/S.185 of the
Motor Vehicles Act, 1988. Under the amended law of Motor
Vehicle Statutory defences available to the insurer in
respect of breach of terms and conditions, if the driver plies
under influence of alcohol or drugs and therefore by
making the present application the insurer wants to insert
the said defence by amending written statement.
3. Considering the application, if the proceeding is
consider it is still at the stage of appearance of opposite
party and therefore by taking linient view, I pass the
following order.
ORDER
Application is allowed subject to payment of cost of
Rs.500/- to the applicant and Rs.500/- to Legal Aid.
