IN CLAIM APPLICATION NO.1367 OF 2013
1. This application has been made by the applicant- Amir @ Ameer
Salim Khan praying to pay the amount of compensation of Rs.71,816/-
as per Judgment dated 26.02.2019 passed in MACP No.1367/2013,
which was deposited by the Insurance company in the name of Account
Officer. It is thus prayed that the amount deposited in the name of
Account Officer be paid to him.
2. The application is supported by the affidavit of the applicant and
also the copy of the Judgment dated 26.02.2019 in MACP
No.1367/2013. I have perused the report of Account Officer, MACT,
Mumbai.
3. The minor applicant- Amir @ Ameer Salim Khan has now
become major. The documentary proof i.e. copy of Aadhar Card and
PAN Card etc. filed on record substantiates his date of birth i.e.
21.11.2002. Hence, I am inclined to allow this application and discharge
his next friend.
4. Thus, considering the circumstances before me, I am of the
opinion that the application deserves to be allowed. Hence, the
following order:-
ORDER
1. The Misc. Application is allowed.
2. Amount of compensation of Rs.71,816/- payable to the applicant-
Amir @ Ameer Salim Khan as per Judgment dated 26.02.2019 in
MACP No.1367/2013 which was deposited in the name of Account
Officer be paid to the applicant by NEFT/RTGS on due verification and
identification.
3. Misc. Application No.150/2022 is disposed off.
