1. Read the application. Heard Ld. Adv. M. S. Bagwanfor
applicant. Perused the report of Accounts officer dated
03.03.2021 and Writ Report dated 22.03.2021.
2. Perused the true copy of order of Hon'ble Bombay High
Court dated 12.03.2020 in First Appeal No.829 of 2018 with
Interim Application No.1 of 2020 with Civil Application
No.240 of 2017. As per the said order, appeal is withdrawn.
3. Accordingly, now in view of the order of Hon'ble
Bombay High Court the present amount needs to be paid to
the concerned. Therefore, the following order.
ORDER
1. Application is allowed as prayed for.
2. Accounts officer, MACT, Mumbai is directed to call back
the invested amount of Rs.2,87,000/ which is the share of
Respondent Mrs. Pramila @ Premila and pay the said amount
with accrued interest to her as per original apportionment
order in MACP No.2643 of 2006.
3. Accordingly, Misc. Application No.70 of 2021 in MACP
No.2643 of 2006 stands disposed of.
