NO. 86/SW/2022 2. Suraj Kumar s/o Rampal Gautam …. Applicant/Accused V/s. The Union of India Through Bandra Terminus Railway Protection Force, Mumbai. .… Respondent. Appearance :- Shri. G. K. Shetty, Ld. Advocate for the Applicant/accused. Shri. A. K. Singh, Ld. Sr. P. P. for the Respondent. ORDER PASSED BELOW BAIL APPLICATION EXH. 27. (Passed on 31st day of July, 2026) This is an application for fresh bail moved by the accused namely Suraj Kumar s/o Rampal Gautam in connection with C. R. No. 10/2022 registered in the Bandra Terminus Railway Protection Force, for the offence punishable under section 3 (a) of the RP (UP) Act. 2. The Ld. Advocate Shri G. K. Shetty for the accused submitted that the accused could not remain present before the Court on earlier date due to unavoidable circumstances. He further submitted that the accused had no intention to delay or derail the proceedings, and now the accused undertakes to appear regularly before the Court and abide by the conditions as may be imposed on him. 3. Accordingly, say of Ld. Sr. P. P. was called. Ld. Sr. P. P. has filed his say and objected the application on the grounds that if the accused released on bail he would abscond. The accused would also pressurize the prosecution witnesses. 4. On perusal of the record, it is evident that the accused -- 1 of 3 -- was absent, which led to the issuance of a non-bailable warrant against him. However, the accused is now in custody and has expressed his willingness to abide by the conditions of bail and co- operate with the trial. The offence in question is non-bailable and cognizable, and the trial is at initial stage. Therefore, it would not be just and proper to keep the accused behind the bar for uncertain period, as the trial would take its own time to conclude. Hence, if the bail application is allowed thereby imposing certain conditions, it would meet the ends of justice. Hence, in result thereof, I pass the following order :- ORDER 1. The Bail Application No. 256 of 2026 is allowed and disposed of. 2. Accused namely Suraj Kumar s/o Rampal Gautam is released on bail on executing his P. R. Bond of Rs.15,000/- (Rupees Fifteen Thousand Only) with one solvent surety in the like amount. Provisional cash bail of Rs. 15,000/- (Rupees Fifteen Thousand Only) is allowed for Four weeks. 3. The Earlier bail bonds/cash bail of the accused be forfeited to the State, if same were not forfeited earlier. 4. The accused shall attend each and every date fixed for hearing and shall not tamper the prosecution evidence till conclusion of trial. 5. Accused shall submit authenticated copy of his identity and address proof. 6. Office to inform to the accused immediately. Issue letter to the Jail Authority accordingly. Date :- 31.07.2026.
