JUDGMENT
(Delivered on 12th day of September, 2018)
The accused voluntarily plead guilty. Therefore, the
accused is liable to be convicted. The accused submits that she is
poor person and only earning member of her family. She further
submits that this is her first offence. Therefore, the accused prayed
for leniency. Considering submissions of the accused, in my view,
lenient view will have to be taken. Hence, I pass the order :

ORDER
(01) The accused namely Rubina Maksood Alam
Shaikh, R/o.: Madanpura, Room No. 36, India
Bakery, Maulana Azad Road, Mumbai is convicted
for the offence punishable under section 147 of the
Railways Act vide section 252 of the Code of
Criminal Procedure and she is sentenced to suffer
simple imprisonment for 10 (Ten) Days.
(02) The accused is further convicted for the offence
punishable under section 145(b) of the Railways Act
vide section 252 of the Code of Criminla Procedure
and she is sentenced to sufer simple imprisonment
10 (Ten) Days.
(03) The accused is further convicted for the offence
punishable under section 146 of the Railways Act
vide section 252 of the Code of Criminla Procedure
and she is sentenced to sufer simple imprisonment
10 (Ten) Days.
(04) Set off under section 428 of the Code of
Criminal Procedure be given to the accused in
sentence from 10.09.2018 till date.
