1] The applicant Balasaheb Dadu Kamble has filed
application for return of mobile handset, Lava made, IMEI No.
911538401395154 / 911538402077652. The Investigating Officer and
Ld. APP have no objection for returning the seized mobile to the
applicant.
2] I have gone through the record. The applicant has not filed
any document to show that the seized mobile is owned and prima-facie
possessed by him. Therefore, it would not be just and property to
return the seized mobile to the applicant. Hence, the application is
liable to be rejected. Therefore, the order :
ORDER
The application is rejected.
