36th COURT, MUMBAI CENTRAL RAILWAY, MUMBAI.
BAIL APPLICATION NO. 111 OF 2026
IN
C.C. NO. 103/SW/2024
Karan s/o Kedar Giri @ Samir …. Applicant/Accused
V/s.
The Union of India
Through Bandra Terminus
Railway Protection Force, Mumbai. .… Respondent.
Appearance :- Shri. H. A. Vora, Ld. Advocate for the
Applicant/accused.
Shri. A. K. Singh, Ld. Sr. P. P. for the
Respondent.
ORDER PASSED BELOW BAIL APPLICATION EXH. 08.
(Passed on 12th day of March, 2026)
This is an application for fresh bail moved by the
accused namely Karan s/o Kedar Giri @ Samir in connection with
C. R. No. 13/2024 registered in the Bandra Terminus Railway
Protection Force, for the offence punishable under section 3 (a) of
the RP (UP) Act.
2. The Ld. Advocate Shri H. A. Vora for the accused
submitted that the accused could not remain present before the
Court on earlier date due to unavoidable circumstances. He further
submitted that the accused had no intention to delay or derail the
proceedings, and now the accused undertakes to appear regularly
before the Court and abide by the conditions as may be imposed
on him.
3. Accordingly, say of Ld. Sr. P. P. was called. Ld. Sr. P. P.
has filed his say and objected the application on the grounds that
if the accused released on bail he would abscond. The accused
would also pressurize the prosecution witnesses. The accused is an
habitual offender.
4. On perusal of the record, it is evident that the accused
-- 1 of 2 --
was absent, which led to the issuance of a non-bailable warrant
against him. However, the accused is now in custody and has
expressed his willingness to abide by the conditions of bail and co-
operate with the trial. The offence in question is non-bailable and
cognizable, and the trial is at initial stage. Therefore, it would not
be just and proper to keep the accused behind the bar for uncertain
period, as the trial would take its own time to conclude. Hence, if
the bail application is allowed thereby imposing certain conditions,
it would meet the ends of justice. Hence, in result thereof, I pass
the following order :-
ORDER
1. The Bail Application No. 111 of 2026 is allowed and
disposed of.
2. Accused namely Karan s/o Kedar Giri @ Samir is
