O- Accused No. 1 viz. Arman Ali Irshaad Ali, Accused No. 2 viz. Imran Ahmad Abdul Rashid Ansari and Accused No. 3 viz. Shaban Imran Ahmad Ansari are hereby convicted for the offence punishable under section 143 of the Railways Act, 1989 vide section 246 (3) of the Code of Criminal Procedure and Accused No. 1 and 2 are sentenced to pay fine amount of Rs. 10,000/- (Ten Thousand) Each in default of payment of fine the both accused shall suffer Simple Imprisonment for 01 (One) Month Each and Accused No. 03 is sentenced to pay fine amount of Rs. 5,000/- (Five Thousand) in default of payment of fine the accused No. 3 shall suffer Simple Imprisonment for 01 (One) Month.
Out of the fine amount, an amount of Rs. 10,000/- (Ten Thousand) be given to western railway, as a compensation vide section 357 (1) of Criminal Procedure Code.
The seized 26 Live Tickets, 10 Used Tickets and 1 Agent Token be destroyed after the appeal period is over.
The seized 1 Redmi made mobile handset, 1 Oppo made mobile handset and 1 Acer made Laptop if in working condition be auctioned and proceeds of sale be credited to Western Railway\''s account, as per rule. If this article is not in working condition it be disposed off as per the rules after the appeal period is over.
The seized ticket amount be confiscated to the Western Railway.
Copy of judgment be given to the accused free of cost.
