IN THE COURT OF METROPOLITAN MAGISTRATE,
55TH COURT, VILE PARLE, MUMBAI

ORDER BELOW EXH.41
The application is filed by the accused to grant him
permission to travel abroad for the purpose of marriage of his nephew.
He filed on record the copy of the air tickets and his affidavit showing
that, he would come back in India on 20/02/2023.
2. Say is called from the prosecution. Ld.APP submitted that,
conditions may be imposed upon the accused.
3. Heard Advocate for the accused and Ld.APP. The accused
has filed invitation card as well as air tickets to and fro Mumbai
Nairobi. The date of marriage is 09/02/2023. The air tickets filed on
record show that, the accused would be flying at 4:55 am of
09/02/2023 and would reach to Nairobi at 1:15 pm. of the same day.
He has assured to come back in India on 19/02/2023. So the
application of the accused to travel abroad is granted on following
conditions
1) The accused to report immediately to the Court on his returning
back to India within 72 hours of his arrival.
2) The accused shall not commit any kind of offence during his
tenure at abroad.
3) The accused shall file undertaking to that respect.
