Order below Bail Application no. 170/BA/2026 in
C.R. No. 397/ 2026 of P. S. Bhandup.
1] This is an application for bail by accused Mr.
Somesh Sachidanand Sawant.
2] Perused the application and say by learned APP
and I.O..
3] Heard learned counsel for accused and learned
APP.
4] It appears that there is no criminal antecedent
against accused. There is no property to be recovered
from the accused. Therefore, no purpose will be served
by detaining the accused longer in custody. Accused was
arrested on 25.04.2026 and since then he is in custody.
Pretrial incarceration of accused is improper hence, I do
not want to deviate from the rule i.e. bail is rule and jail
is exception. Hence, following order;
ORDER
A] Accused Ahmed Mr. Somesh Sachidanand Sawant
be released on bail on his executing PB & SB of Rs.
15,000/- (Rs. Fifteen Thousand only) or provisional
cash bail of Rs. 10,000/- .
B) Accused shall not tamper the prosecution evidence,
more particularly, informant and witness by any

means, what so ever.
C] Accused shall attend the police station on each
Monday in between 10.00 am to 01.00 pm till
filing of the chargesheet or for the period of two
months whichever is earlier.
D] Accused shall co-operate the investigating officer.
E] Accused shall produce address proof of two blood
relatives to the Investigating Officer, who shall
verify the address proof and file the report.
