ORDER BELOW EXH. 10
1) This is an application filed by complainant
under section 143-A of The Negotiable Instrument Act.
Perused the application, record and considered argument
of Ld. Advocate of complainant.
2) Heard Ld. Advocate for the complainant Shri.
Anil C. Gupta.
3) It has stated in the application and submitted
by Ld. Advocate for applicant that, the complaint has
filed under section 138 of The Negotiable Instrument
Act. The amount of cheque is Rs. 1 lakh. Complainant
filed this application for interim compensation of 20% i.e.
Rs. 20,000/-. Complainant is in urgent need of money.
Hence, requested to allow the application.
4) Accused has neither filed his say nor made
argument.
5) On perusal the record it appears that, cheque
is of Rs. 1 lakh. It has dishonoured. In this complaint
plea has also recorded. From the record it appears that,
complainant has made out prima facie case under section

138 of Negotiable Instrument Act. Therefore, it is just
and proper to grant 20% compensation to the
complainant. Hence, I proceed to pass the following
order.
ORDER
tL. The application is allowed.
2: Accused is directed to pay the interim
compensation of Rs. 20,000/- (Rs. Twenty Thousand
Only) to the complainant within 60 days since today.
