Pdf Text: ORDER below Exh 01
Accused absent when called out. NBW report shows that accused
is not residing on the given address. Prosecution fail to furnish correct
address of the accused. There is no possibility to secure the presence of
the accused in near future.
2. Today, the special drive is organized as per the directions of
the Hon'ble Bombay High Court vide
Letter No.B(Gen)-1001/2023/632,
dated 01.04.2023 to dispose off old and ineffective matters. In my view,
this is a fit case where resort can be taken to the provisions of section
258 of Cr.P.C. to stop the complaint. Hence, order :-
ORDER
1. Proceeding is stopped u/s. 258 of CrPC.
2. Accused is released.
3. Cash surety of stands forfeited to the Government.
4. JC and cashier to comply.
