ORDER BELOW EXH01
This is the complaint u/sec. 138 of N. I. Act. The
complaint was presented on 14.05.2019. On 24.09.2019 process
was issued against accused. Since then matter is pending for
recording plea of the accused. Record discloses that no appropriate
steps were taken by the complainant to secure the physical presence
of the accused. Today also, the complainant and advocate are
absent. Neither adjournment nor exemption is sought. No purpose
will be served by keeping the matter pending. Hence, the complaint
is dismissed for want of prosecution. Hence, I pass the following
order.
ORDER
i) The complaint is dismissed vide section 256 of Cr. P. C.
ii) The accused is acquitted of the offence punishable u/sec.
138 of N. I. Act.
