ORDER PASSED BELOW APPLICATION FILED BY ACCUSED/APPLICANT
FOR ISSUANCE OF PASSPORT
1. Perused the application and read the say of I.O & Ld. APP. Read
the documents filed with the application. Heard both the sides. Applicant
has made this application for issuance of passport. He is accused in C.R
No.484/2018 registered with Sakinaka Police Station for the offences
punishable under section 285 of Indian Penal Code with Sections 394, 371
of Mumbai Municipal Corporation Act. r/w. Section 4, 21 of Environment
(Protection) Act. He is on bail. He made application for issuance of
passport. However, the concern passport authority has directed him to
approach before this court. Hence, he was constrained to file present
application. Ld. A.P.P has no objection for grant of application.
2. Offences punishable under section 285 of Indian Penal Code
with Sections 394, 371 of Mumbai Municipal Corporation Act. r/w. Section
4, 21 of Environment (Protection) Act. are alleged against accused. He is
not seeking permission to travel abroad. Therefore, I am of view that no
prejudice will cause to the prosecution if the prayer of the applicant is
granted. Applicant is seeking permission for issuance of passport only.

Application deserves to be allowed. In result, I pass the following order:
O R D E R
1 The application is allowed.
2 No objection is granted for issuance of passport as per the
provisions of Indian Passport Act and Rules & Regulations made
thereunder.
3 The applicant/accused shall submit verified copy of his passport
and other relevant documents with the Investigation Officer.
