LAC No.659/2023 State V/s.Shatrudhan Bhola Mahto Offence Punishable Under Section 8 (C) of The Narcotic Drugs and Psychotropic Substances Act Police Station – Versova Exh.No.3 JUDGMENT UNDER SECTION 252 OF CODE OF CRIMINAL PROCEDURE (Passed on 30/11/2023.) The accused, Shatrudhan Bhola Mahto, Age – 26 Years, R/o. Kapaswadi Zopadpatti, Near Vinayak Tower, D. N. Nagar, Andheri (W), Mumbai, is alleged to have consumed Narcotic Drug/ Psychotropic Substances on 28/11/2023 at about 11.5 hrs. Near Jama Masjid, Silva Pakhadi Road, Versova Gaon, Andheri (W), Mumbai. 2. Today the accused is produced before me at about 1.22 p.m. through Police Constable Shri Javed Shaikh (P.C.No.113238). The accused filed the pursis at Exh.No.2 and thereby pleaded guilty. The accused further prayed to show lenient view while imposing the punishment. 3. Having gone through the record, it appears that the accused has voluntarily pleaded guilty. According to him, he is a sole earning member of his poor family. Hence, considering the age of the accused, his responsibility towards his family and the nature of offence, the following order would meet the ends of the justice: ORDER i] The accused, Shatrudhan Bhola Mahto is hereby convicted for the offence punishable under section 8 (C) of The Narcotic Drugs and Psychotropic Substances Act as per Section 252 of Cr. P.C. ii] The accused is sentenced to pay fine of Rs.4,000/ (Rupees Four Thousand Only). In default of payment of fine, he shall suffer simple imprisonment for seven days. iii] The accused is directed to comply the provision of Section 437 (A) of Cr.
