The offence alleged against accused is punishable under Sec.392 r/w Sec.34 of Indian Penal Code. Therefore, considering the nature of offence, the plea of accused is accepted and I proceed to pass the following order: O R D E R 1) The accused Himanshu Mahesh Varma is convicted as per sec. 241 of Cr.P.C for the offence P/U/Sec. 392 r/w Sec.34 of IPC and he is sentenced to suffer simple imprisonment for One year & to pay fine of Rs.1,000/ (Rs. One Thousand Only) & in default to suffer S. I. For 5 days. 2) Accused be given set off against the term of imprisonment imposed on him vide Sec.428 of the CrPC. 3) Seized muddemal be returned to the informant (if not returned) after appeal period is over.
