J U D G M E N T
(Delivered on 16/07/2022)
1. The accused is chargesheeted for the offence punishable
under Section 143(1) of the Railways Act. As per the case of the
prosecution, on 23/04/2018 at Chisti Enterprises and Travels, Juhu Galli,
in front of Aksa Masjid, Andheri (W), Mumbai, the accused was found
doing illegal business of selling Etickets of Railway Authority for traveling
to the passengers without having any legal licence.

2. The accused is present. The accused pleaded guilty. I have
verified the accused. The accused has voluntarily pleaded guilty. Hence, I
accept the same. I have heard the accused on the point of sentence. He
prayed for leniency the following order. :
ORDER
1] The accused Nasiruddin Jahiruddin Shaikh is convicted for
the offence punishable under Section 143(1) of the Railways Act vide
Section 241 of Code of Criminal Procedure and he is sentenced to pay a
fine of Rs.10,000/, in default to suffer simple imprisonment for one
month.
2] Order regarding muddemal property :
(i) 09 tickets of railway be returned to Railway Administration.
(ii) 09 used tickets of railway be returned to Railway Administration.
(iii) 01 laptop of Dell company be returned to accused.
(iv) 01 dongal of Multi Link be returned to accused.
(v) 01 mobile be returned to accused.
3] The amount of above fine be adjusted out of the cash bail amount
deposited by accused on 24/04/2018.
4] Copy of judgment be given to the accused free of cost.
