This is the complaint filed under Section 138 and 141 of the Negotiable
Instruments Act. Both parties are present with their learned advocates. The matter was
referred for mediation as per the request of the both parties. The matter was settled in
the mediation. So also, during the pendency of the case, the complainant filed
application for permission to withdraw the complaint
inter-alie submitting that the
matter has been settled between both the parties. The complainant further submits that it
does not want to proceed further with this matter. Thus, it appears that, the matter is
settled between both the parties. Hence, I proceed to pass the following order:
ORDER
(i) The application for withdrawal of the complaint is
allowed.
(ii) The accused No.1 to 3 are hereby acquitted from the
offence punishable under section 138 and 141 of the
Negotiable Instruments Act. Bail bond furnished by the
accused stands cancelled.
(iii) The original documents i.e. cheque and other documents,
if filed on record, be returned to the concerned party.
(iv) Court fee stamps, if any, be refunded on demand only as
per rules.
(v) The case be closed accordingly.
