ORDER PASSED BELOW EXH1
Perused the record. It appears that the case is for recording
order on delay condonation application. Complainant is present and
filed application dated 02/03/2020 for permission to withdraw the
complaint stating therein that the accused has cleaned all his due
payments and therefore he wants to withdraw the complaint.
Considering the application dated 02/02/2020, sufficient grounds are
available for permitting to the complainant to withdraw the complaint.
Hence, following order is passed :
ORDER
(i) The application dated 02.03.2020 for withdrawal of the complaint
is allowed.
(ii) The complaint is hereby permitted to be withdrawn as disposed of
as per section 257 of the Criminal Procedure Code.
(iii) The accused is acquitted in view of the compounding the offense.
(iv) Court fee stamps, if any, be refunded on demand only as per rules.
