COMMITTAL ORDER BELOW EXH.1
Today, the accused no. 1 Amin, no. 4 Javed and no. 5 Bhushan
are present before the Court. They are on bail. Accused no. 2 Mubarak
is produced by jail authority today. Accused no.3 Jamir is not produced
by jail authority of Taloja Jail. This court has tried to take him on V.C.
However, Jail Authority Taloja informed that accused is not ready to
come before V.C. Therefore, Taloja Jail is informed about committal of
present case on V.C. against the accused no.3 Jamir. Ld. Advocate of
accused Shri R.P. Mishra present. Present accused are charged with the
offences punishable under sections 386, 387, 364-A, 506 (2) r/w 34 of
Indian Penal Code and Sections 4 r/w 25 of Indian Arms Act. The
offence punishable under section 364-A of IPC is exclusively triable by
the Court of Sessions. The copies of police report and other documents,
as specified in section 207 of the Code of Criminal Procedure have been
supplied to the accused. The case will have to be committed to the
Court of Sessions Judge, Dindoshi. Hence, the order :-
O R D E R
1 The case be committed to the Court of Sessions Judge,
Dindoshi.
2 The accused no. 1 Amin, no.4 Javed and no.5 Bhushan are
directed to appear before the Court of Sessions Judge,
Dindoshi on 17/01/2020.

3 The Jail Authority of Thane Jail and Taloja Jail are
directed to produce the accused no.2 Mubarak and no.3
Jamir @ Vastara before the Court of Sessions Judge,
Dindoshi on 17/01/2020. Inform Taloja Jail accordingly.
4 The record of the case, the documents and articles, which
are to be produced in evidence, shall be sent to the Court
of Sessions Judge, Dindoshi immediately.
5 The Police Station Officer, Police Station Powai be directed
to produce muddemal property in the Court of Sessions
Judge, Dindoshi on or before 17/01/2020 positively.
6 The Public Prosecutor shall be notified of the commitment
of the case to the Court of Sessions Judge, Dindoshi.
