ORDER BELOW APPLICATION DTD.17/12/2018
Read the application, affidavit, documents filed with
the application. Heard Ld. counsels for applicant, at length.
She submitted that, brotherinlaw of applicant and other
respondents committed domestic violence against applicant and
same is continued. She further submitted that, brotherinlaw of
applicant outraged her modesty, in that regard applicant lodged
report in the concern police station. Further, she submitted that,
now respondents are trying to drove applicant out of the house,
therefore, she has to approach to the court for the relief under
the provision of The Protection of Women From Domestic
Violence Act. She further argued that, if applicant is not
protected by way of protection order, she will be dispossessed
from shared household. Therefore, prayed for adinterim relief.
2. If considered the submission made by Ld. counsel for
applicant and documents placed on record, primafacie it
appears that, applicant lodged N.C. and report in respect of
cruelty at the hands of respondents, the allegations made by the
applicant primafacie found to be genuine, in respect of
domestic violence, so as to grant adinterim relief. Hence, the
respondents are hereby restrained from committing any
domestic violence against applicant. Further, they are

restrained from dispossessing the applicant and her children
from shared household, where she resides, adinterim relief will
continue till the appearance of respondents before the court.
3. Issue notice to respondents, as to why the above said
reliefs should not be continued till the disposal of the main
application, returnable on 14/01/2019
4. Informed concern police station accordingly.
5. Copy of order be furnished applicant free of cost.
