This is the complaint filed under Section 138 of N. I. Act. The accused
appeared before this Court. The matter was referred for mediation as per the request
of the accused and complainant. The matter was settled in the mediation. So also,
during the pendency of the case, the complainant filed application (Exh.No.5) for
permission to withdraw the complaint interalie submitting that she received all the
due amount. The complainant further submits that she does not want to proceed
further with this matter. Thus, it appears that, the matter is amicably settled
between both the parties. In view of the order passed below Exh.No.5, I proceed to
pass the following order:
ORDER
(i) The application for withdrawal of the complaint is
allowed.
(ii) The complaint is hereby permitted to be withdrawn as
disposed of as per section 257 of the Criminal
Procedure Code.
(iii) Court fee stamps, if any, be refunded on demand only
as per rules.
(iv) The case be closed accordingly.
