ORDER BELOW EXH.1
Today when I perused record, it is come to my notice that
Mr. Mathew Colaco has filed this complaint on behalf of Jet Airways
Employees Co.op. Credit Society Ltd. Affidavit of verification u/s.200
of Cr.P.C. is tendered by Mr. Shantaram N. Pawar as A/R of Jet Airways
Employees Co.op. Credit Society Ltd. No permission is sought from the
Court for substitution of authorized representative of Jet Airways
Employees Co.op. Credit Society Ltd. Even this fact was not brought to
the notice of the Court. On the basis of affidavit of Mr. Shantaram N.
Pawar process is issued against accused. Today, I got the occasion to go
through in detail because, it is listed for tendering affidavit of
examination in chief of A/R of complainant. One lady enter the witness
box as A/R of complainant and ld. Advocate for complainant made a
submission that he is going to tender affidavit of examination in chief of
that lady. It important to note that, that lady is not substituted in the
place of Mr. Mathew Colaco. So, complainant to show cause why
action should not be taken for getting the order by suppressing material
facts from the Court.
