ORDER PASSED BELOW EXH1
Perused the record. The complainant filed application for
permission to withdraw the complaint stating therein that the accused paid
the complaint amount to complainant. Hence, he do not wish to proceed the
case against the accused persons. Mediation report dated 23/11/2022 of the
Metropolitan Magistrate, 48th Court, Andheri, Mumbai, is also filed on record.
Hence, following order is passed :
ORDER
(i) The application for withdrawal of the complaint is
allowed.
(ii) The complaint is hereby permitted to be
withdrawn as disposed of as per section 257 of the
Criminal Procedure Code.
(iii) The accused is acquitted in view of the
compounding the offense.
(iv) Court fee stamps, if any, be refunded on demand
only as per rules.
