ORDER PASSED BELOW EXH. 01
The Hon'ble High Court, Mumbai has directed to undertake
Special Drive on 17.06.2023. Despite of issuing summons many times,
presence of the accused is not secured. The offence punishable under
section 142 of Maharashtra Police Act. There is no possibility that
presence of accused will be secured in near future by the prosecution.
The record of the case makes it clear that the present case is appropriate
where powers under section 258 Cr.P.C. can be invoked. Therefore, for
the reasons recorded above I pass following order:
ORDER
1. The proceeding is stopped U/Sec.258 of the Code of Criminal
Procedure.
2. The accused is discharged in his absence of the offence
punishable Under Section 142 of Maharashtra Police Act.
