Matter is taken up in today’s special drive. Today also
complainant and advocate are absent. Perusal of roznama and record
shows that matter is matter is pending for compliance of order dated
15/02/2019. Comlainant was directed to argue on point of issuance of
process. However, complainant did not appear before the Court and
proceed with the argument. This conduct of the complainant itself is
sufficient to show it’s loss of interest and total disregard. In these
circumstances, there is no alternative than to dismiss the matter. Hence,
the complaint is dismissed for want of prosecution under Section 256 of
Cr. P.C. Accused are discharge for the offence punishable under Section
138 of N.I. Act. Proceeding stands closed.
