ORDER BELOW EXH. 01
The complainant is absent when called out repeatedly. Ld.
advocate for complainant is also absent. Perused the record. It reveals
that the process against the accused came to be issued on 14/08/2019
and since then matter is pending for appearance of accused. It seems
from the record that, the complainant had filed his last application on
09/12/2021 to issue summons to the accused and thereafter
complainant has not taken any steps to secure presence of the accused.
Matter is of the year 2018 that means 7 years old. Further it seems that
the complainant is not keenly interested to proceed further. In such
circumstances, it would not be appropriate to keep the matter pending
unnecessary without any progress. In result I pass following order:-
ORDER
1. The case is dismissed vide Section 256 of Cr.P.C. and the
accused is discharged.
2. Record and proceeding be sent to record room after
necessary compliance.
