ORDER PASSED BELOW EXH1
Perused the record. It appears that the case is for filing
evidence affidavit of the complainant. Complainant is present and filed
application dated 28.09.2021 for permission to withdraw the complaint
stating therein that M/s. Maharaja Trading has left the country and may
not return and the legal heirs and/or his property is not known to the
complainant and hence he wants to withdraw the present matter
amicably. Hence, following order is passed. :
ORDER
(i) The application dated 28.09.2021 for
withdrawal of the complaint is allowed.
(ii) The complaint is hereby permitted to be
withdrawn as disposed of as per section 257 of
the Criminal Procedure Code.
(iii) The accused are acquitted in view of the
compounding the offense.
(iv) Court fee stamps, if any, be refunded on
demand only as per rules.
