ORDER BELOW APPLICATION FOR RETURN OF PROPERTY
VIZ. Cash sum of Rs. 66,120/
By this application the applicant Mr. Satish Bhoja Shetty
is seeking return of seized stolen muddemal property i.e. Cash sum of
Rs. 66,120/ being entitled for the same. It is further alleged that,
MIDC police have seized the said muddemal in connection with this
crime. He is ready to produce the said property whenever required till
final disposal of case. The application is supported by various
documents such as copy of F.I.R., affidavit of applicant in support of
application for return of property of the applicant.
2. Accordingly, say of Ld. APP for the State were called. I. O.
filed his say and thereby rendered no specific objection to release the
said recovered property, accused had given his no objection. As per say
of the I.O. during investigation, total Cash sum of Rs. 66,120/
recovered in this crime.
3. Heard argument, perused the record.

4. Considering the reasons mentioned in application
supported by documents, it is evident that, the aforementioned seized
stolen muddemal property viz. Cash sum of Rs. 66,120/ may be
temporarily released in favor of the applicant, being legally entitled
for the same, as upon lodging FIR by applicant, the said muddemal
came to be recovered. Hence, upon imposing certain conditions the said
property may be released in favor of applicant. Hence, the following
order :
ORDER
1 The seized/recovered stolen muddemal property i.e. total
cash sum of Rs. 66,120/ be released in favor of applicant on
his furnishing indemnity bond of र.66,120/ (Rs. SixtySix
Thousand one hundred twenty only)
2 Applicant shall produce the said property as and when
required by the Court. Applicant shall not dispose off or
alienate the same till the disposal of the proceeding.
3 Investigation Officer shall draw panchanama regarding the
said property and shall obtain photographs of seized
muddemal from all angles for its proper identification in
future and the same be kept alongwith chargesheet.
4 This proceeding be kept alongwith the chargesheet.
5 Copy to the concerned police station for compliance of this
order.
