COMMITTAL ORDER BELOW EXH.1
Today, the accused no. 1 Sachin Godse is present before the Court. He
is on bail. Accused no. 2 Ajay Mali is not produced by jail authority of Arthur
Road Jail. He is taken on V.C. today. He informed that he received copy of
chargesheet on V.C. Ld. Advocate of accused absent. Present accused are
charged with the offences punishable under sections 353, 504 r/w 34 of
Indian Penal Code. The offence punishable under section 353 of IPC is
exclusively triable by the Court of Sessions. The copies of police report and
other documents, as specified in section 207 of the Code of Criminal
Procedure have been supplied to the accused. Accused submitted that they
will engage advocate of their choice for their defence before the Sessions
Court. The case will have to be committed to the Court of Sessions Judge,
Dindoshi. Hence, the order :-
O R D E R
1 The case be committed to the Court of Sessions Judge,
Dindoshi.
2 The accused no. 1 Sachin Godse is directed to appear before the
Court of Sessions Judge, Dindoshi on 20/03/2020.
3 The Jail Authority of Arthur Road Jail is directed to produce the
accused no.2 Ajay Mali before the Court of Sessions Judge,
Dindoshi on 20/03/2020. Inform Jail accordingly.
4 The record of the case, the documents and articles, which are to
be produced in evidence, shall be sent to the Court of Sessions
Judge, Dindoshi immediately.
5 The Public Prosecutor shall be notified of the commitment of
the case to the Court of Sessions Judge, Dindoshi.
