ORDER PASSED BELOW EXH1
Perused the record. It appears that the case is for filing
evidence of the complainant. Mr. Akhil Baldawa, authorized
representative of the complainant Bhotoria Refrigeration Ptivate Ltd. is
present and filed application dated 24/02/2020 for permission to
withdraw the complaint stating therein that the present matter is
amicably settled amongst the parties and the accused herein has paid
the total outstanding amount to the complainant and the complainant
has duly received the same, therefore complainant does not wish to
proceed with complaint. Considering the application, sufficient grounds
are available for permitting to the complainant to withdraw the
complaint. Hence, following order is passed :
ORDER
(i) The application dated 24.02.2020 for withdrawal of the complaint
is allowed.
(ii) The complaint is hereby permitted to be withdrawn as disposed of
as per section 257 of the Criminal Procedure Code.
(iii) The accused is acquitted in view of the compounding the offense.
(iv) Court fee stamps, if any, be refunded on demand only as per rules.
