Perused the complaint, verification of the complainant and
documents annexed with complaint. Heard the learned Advocate
Shri.Pankaj Dubey for the complainant. From the perusal of the
record, it reveals that ECS of Rs.40,976/ deposited by the
complainant to its bank i.e. Yes Bank Ltd Branch at Andheri dated
20.08.2018 got dishonoured vide memo dated 24.08.2018 by the
accused bank with remark “Balance insufficient”. Notice was issued to
the accused which is received by the accused on 19/09/2018 but the
accused have not made payment of ECS amount within 15 days and
thus cause of action arose on 05.10.2018. The complaint is filed
within limitation i.e. on 03/11/2018. Hence, there are sufficient
grounds to proceed further against the accused. Hence, issue process
against the accused for the offence p/u/s 25(c)r/w Sec.27 of The
Payment and Settlement Systems Act, 2007 read with Sec.138 & 141
of N.I. Act.
