This is the complaint filed under Section 138 r/w 141 of the Negotiable
Instruments Act. The complainant appeared before this Court with his learned
advocate. During the pendency of the case, the complainant filed application
for permission to withdraw the complaint
inter-alie submitting that the matter
has been amicably settled between both parties. The complainant further
submits that he does not want to proceed further with this matter. Thus, it
appears that, the matter is amicably settled between both the parties. Hence, I
proceed to pass the following order:
ORDER
(i) The application for withdrawal of the complaint is
allowed.
(ii) The accused is hereby acquitted from the offence
punishable under section 138 r/w 141 of the
Negotiable Instruments Act. Bail bond furnished
by the accused stands cancelled.
(iii) The original documents i.e. cheque and other
documents, if filed on record, be returned to the
concerned party.
(iv) Court fee stamps, if any, be refunded on demand
only as per rules.
(v) The case be closed accordingly.
