ORDER

1. The application is filed by applicant/accused requested
for permission to go abroad from 05.08.2023 to 04.11.2023 at
Yemen for earning his livelihood and for his minor son school
admission. The Ld. APP has filed his say and strongly opposed.
2. Ld advocate for the accused Shri Selvaraj Nadar
submitted that accused obtained NOC from Ministry of External
Affairs, New Delhi. The applicant has also filed on record the
copies of order passed in Misc. Cri. 1236/N/2023, passport, Air
ticket and No objection certificate for travel to Yemen. The
applicant undertakes that he will not commit breach of conditions
if imposed by the Court.
3. I have gone through the documents filed by the applicant.
I perused the NOC issued by Ministry of External Affairs, New
Delhi.

4. Considering all these facts and circumstances, I come to
the conclusion that application is liable to be allowed with certain
conditions. Hence I pass following order :
ORDER
Application is allowed on following conditions :
1) The accused/applicant is permitted to go abroad for business
purpose from 05.08.2023 to 04.11.2023 at Yemen
subject to undertaking that, concern Advocate will conduct
case without challenging identification.
2) The accused/applicant shall furnish the documents in respect
of local as well as permanent address of the same.
3) Accused shall also furnish the address of the place of his stay
in abroad.
4) The accused shall submit before the Court the true copies of
his Passport and the Visa.
5) The accused and the Ld Advocate shall cooperate with the
Court for speedy disposal of the case.
6) The accused shall sent copy of this order immediately to
concern police station by speed post for necessary
information.
7) The above permission shall not be used by the
accused/applicant in any manner for any unlawful activity.
