ORDER BELOW THE APPLICATION OF ACCUSED/APPLICANT FOR
ISSUANCE FRESH PASSPORT.
1. This is an application made by accused/applicant Nikesh
Anant Davne to issuance of fresh passport. Accused is charge-sheeted
for the offence punishable under Section 452, 143, 147, 149, 294, 323,
500, 504, 506, 509 of the Indian Penal Code and Section 66(c) of the
Information Technology Act. The case is pending before this Court. The
accused used to remain present before the Court. The accused/applicant
is holder of Indian Passport bearing No.P1651539 and the same is likely
to be expired on 27/07/2026. Hence, he prayed for permission for
renewal of the passport as per the provisions of Passport Act.
2. The learned APP has opposed the application.
3. The accused/applicant undertakes to attend the Court
regularly either in person or through his advocate. Hence, considering
the necessity of the renewal of the said passport and the conduct of the
accused, I pass the following order:
O R D E R
1. Application is allowed.
2. Passport Authorities may consider the applicant's prayer for
renewal of passport as per prescribed Rules, as this Court has no
objection for renewal of passport.
