ORDER BELOW EXH. 1
Perusal of record shows that summons issued to accused is
duly served on 20/06/2019. Despite of service of summons accused
was absent. It is evident from record that on 20/06/2019 complainant
and advocate were absent. No steps taken. On 07/09/2019 matter
was kept for further order. It is also apparent from the roznama dated
07/09/2019 that on said date both complainant and advocate were
absent. No steps taken. Still hearing was adjourned till today.
2. Today I called out complainant as well advocate. No one
appeared. No steps taken. Hence, order :
ORDER
i. Complaint is hereby dismissed u/s.256 of Cr.P.C.
ii. Accused is acquitted of the offence punishable u/s.138 of
the Negotiable Instrument Act.
iii. Complaint is disposed off accordingly.
