ORDER BELOW EXH.1
It is evident from the record that on 06/09/2018 process is
issued against accused No.2 with specific direction to the complainant to
collect the summons at the earliest for service. However, it is evident from
record that since from 06/09/2018 neither complainant nor advocate
appeared on appointed dates. They even did not collect the summons as
per directions of the Court. Today also they both are absent. Hence, order
ORDER
1] Complaint is hereby dismissed u/s.256 of Cr.P.C.
2] Accused No.2 is hereby acquitted for the offence punishable
u/s.138 of N.I. Act.
3] Proceeding is hereby disposed of.
