ORDER BELOW EXH.1
It is evident from the record that on 04/04/2019 summons
was lastly issued. However, till 25/09/2019 neither it is served nor
returned unserved. So it was expected from complainant that it should
take steps. However, till 25/09/2019 no steps were taken by the
complainant. On the contrary complainant was absent on 21/06/2019,
25/09/2019. Today also, neither complainant nor advocate appeared
before the Court till 04.10 p.m. From the absence of complainant and
advocate it seems that they are not interested in prosecution of the case.
Hence, order:
ORDER
1] Complaint is hereby dismissed u/s.256 of Cr.P.C.
2] Accused is hereby acquitted for the offence punishable
u/s.138 of N.I. Act.
3] Proceeding is hereby disposed of.
