ORDER BELOW EXH. 1
Perused the record. Since after 6 months of filing this case,
the prosecution has failed to file C.A. report in respect of liquid allegedly
found in the possession of accused. In absence of C.A. report, it cannot
be held that the accused had contravened the provisions under The
Maharashtra Prohibition Act for which he has been charge-sheeted.
Thus, it is apt to stop the proceedings u/Sec. 258 of Cr.P.C.
ORDER
1. Proceeding in this case are hereby stopped u/Sec. 258 of Cr.P.C.
2. The bail amount furnished by accused is forfeited and credited to
State.
3. Case papers be filed.
