ORDER BELOW EXH. 1
The accused is charge-sheeted for the offence p/u/s. 279,
338 of the IPC. The case is very old. The warrants were issued against
accused, however as per police reports his whereabouts are not
traceable. Therefore, inspite of issuing summons and warrants to the
accused, the prosecution has failed to secure his presence since long.
Therefore, considering the nature offence, the present case is a fit to
stop by invoking powers under Section 258 of the Cr.P.C.
2. The accused is hereby released/discharged from the case
and their bail bonds stands cancelled/cash security amount deposited by
the accused, if any, is forfeited and credited to the Government.
3. Proceeding is stopped u/Sec. 258 of Cr.P.C.
