ORDER BELOW APPLICATION FOR CONDITION RELAXATION
1. Heard both the sides. The accused were arrested in connection
with offences punishable U/Sec.353,323 etc of IPC. While granting
bail, some conditions were imposed by the court. Thereafter on
18.08.2018 as per the request of the accused, said conditions were
modified whereby accused (ladies)were directed to not to leave
Mumbai prior to intimation to the court and concern police station in
writing.
2. After hearing the parties, it appears that said conditions is not
so harsh as contended by the applicants/accused. The purpose of
putting such conditions, is to secure the presence of the accused
during trial so that matter should not linger for years together.
However, considering contents of this application and reply of the
state, I proceed to pass following modified order in the interest of
justice :
ORDER
1. The abovesaid condition to continue till submission of charge
sheet.
2. However, for above compliance, accused need not go to police
station personally. They can sent such intimation to police by
RPAD/speed post/courier or through Ld. counsel.
3. Condition regarding intimation to the court stands cancelled.
4. This notice stands disposed of accordingly.
