Deposition of Witness No. 01 for Prosecution.
I on solemn affirmation depose as under :
My Name : Kranti Sarang Patil
Age : 40 years Occupation : P.I., Special Branch-I
R/o. : 101/1B, Rajvaibhav Anex, Raju Nagar, Dombivali(West).
Exam.-in-chief by APP Mr. K. S. Jamdhade for the State:-
1. On the night intervening 18.11.2017 and 19.11.2017 I was
working as a Immigration Officer at Chhatrapati Shivaji Maharaj
International Airport. Airport with Special Branch-II from 08:00 p.m. to
08:00 a.m. I was Duty Officer that night. Around 09:15 p.m. staff of Air
Arabia Airlines of flight No. G9 402, brought the accused Mohd. Ali
before Wing In-charge Mr. Sunil Zarekar as he was deported from
Sharjah to Mumbai. The Airline staff handed over the accused with
passport, deportee note, tourist visa and letter from the Airlines. We
inquired with the accused we learnt that he was deported from
Kingdom of Saudi Arabia. The accused initially went to Sharjah on
Tourist Visa on 12.11.2017 and then he tampered the said visa by
affixing fake employment visa on the passport. The accused was holding
E.C.R. passport, hence it was necessary to obtain Protector of
Emigrants(P.O.E.) for obtaining employment visa. In order to avoid the
process of obtaining P.O.E., the accused initially obtained Tourist Visa
and after reaching Sharjah he procured fake employment visa. The
accused then travelled from Sharjah to Hail, Saudi Arabia. Immigration
Authority, Hail deported the accused to Mumbai.
2. I am now shown the original passport of the accused. My
attention is drawn to page No.5 of the passport on which the said

employment visa is affixed. It is marked as Exh-06. The original
boarding pass of the accused of flight No. G-9 401 dated 18.11.2017, is
now shown to me. It is the same. It is marked as Exh-07. After inquiry
I handed over the accused along with documents to Sahar Police Station
and lodged report against him. The F.I.R. & printed F.I.R. are now
shown to me. They bear my signature. Their contents are true and
correct. They are marked as Exh-08 and Exh-09. I can identify the
accused. He is not present before Court today.

3. It is true to say that I did not mention the passport
number in the F.I.R. on which the alleged employment visa was
affixed. It is true to say that at the time of deportation the
passenger and his documents are handed over to the Airline staff.
It is true to say that I did not receive any documents from Airline
Staff by drawing any seizure panchnama. It is true to say that only
Embassy can state the nature of visa issued on a particular kind of
passport. It is true to say that I did not contact Saudi Embassy to
verify the kind of visa which was affixed on the passport of
accused. It is true to say that I did not mention in the F.I.R. that
employment visa was fake. It is true to say that the alleged
employment visa was obtained beyond India. It is not true to say
accused did not affix any fake employment visa on his passport. It
is not true to say that accused did not use any fake document. It is
not true to say that I lodged false report at the instance of my

senior officer. It is not true to say that today I am deposing false.
